The Delhi High Court has granted interim relief to Dabur India by staying the Food Safety and Standards Authority of India's (FSSAI) recent order that prohibited the sale of food products carrying claims such as "100% Pure", "100% Natural", "100% Organic" and similar declarations, marking a significant development in the ongoing debate over food labelling and advertising claims in India. The court's interim order allows Dabur to continue selling the affected products while the legal challenge is heard.
Dabur had approached the High Court arguing that the FSSAI directive was issued without prior notice or an opportunity to be heard and lacked adequate legal reasoning. The FSSAI had earlier maintained that "100%" claims are ambiguous, unverifiable and likely to mislead consumers under the Food Safety and Standards Act, 2006 and the Food Safety and Standards (Advertising & Claims) Regulations, 2018.
The High Court has issued notice to the food regulator to file its response, with the matter set to proceed through judicial review. The case is expected to have far-reaching implications for food labelling, advertising practices and regulatory enforcement across India's packaged food industry, as companies increasingly face stricter scrutiny over product claims and consumer transparency.
